This could have been handled differently, and more professionally. This could also have scared a lot more if done properly. You should have been more serious, courteous, etc.

Legally we can keep the recordings up, By canadian phone laws, as long as one party knows the conversation is being recorded, it is perfectly legal. If both parties did not know they were being recorded, it's deemed illegal.

We have every right to keep the recordings up, but out of respect for his Father, we are pulling them down for now. M$ Sam and his father are now speaking

For teh record Guise. He didn't commit mail fraud. He told me a while ago in October that he gets his prizes sent to a UPS warehouse in Michigan and since he lives in Ontario its a 30 minute drive from there. According to him he goes there every Saturday to pick shit up.

About recording phone calls in Canada...

Canada is in the one-party notification group. Some USA states are also in this group, but others are two-party. That's why whenever you call a tech support line in America, you get that "This call may be monitored to quality assurance purposes" line.

The thing is, Canada's law regarding phone recording is tailored more towards phone tapping by the government. However, it DOES apply to any phone calls being recorded in Canada, no matter whether there is a government agency involved or not.

The way Canada works, only one of the parties in a phone conversation has to know that the conversation is being recorded. As long as [the person who called] knew that he himself was recording, then the recording was legal. There wasn't a third party, such as the government, involved here. If there was, and that third party had been doing the recording, then one of them (Be it the guy calling or Jake/Family) would have had to be made aware that the conversation was being recorded.

This is based off of:

183.1 CONSENT TO INTERCEPTION -- Criminal Code of Canada, Invasion of Privacy

183. DEFINITIONS -- This page demonstrates that it doesn't matter if the caller is in the United States or in Canada. If the call was intended for someone in Canada, then Canada's law applies in that jurisdiction.

Disclaimer: IANAL, but Jake's dad should probably read up on the law in his country.

Summary: Jake's father is wrong. The recordings that were posted are legal.

Both parties knew it was being recorded eventually, he did tell her that the phone calls were recorded, just at the end, she never really responded or said anything about it.
