I recently sold this Zune on eBay. I provided tracking number to PayPal in transaction details and shipped the item through UPS. She received the item yesterday and sent me an e-mail saying,

I purchased a zune from you and just received it yesterday. When I opened it the box was shmushed at the bottom and the zune has problems. 1. I opened the package and unwrapped the plastic holding the zune. I noticed that there is a scratch on the LCD screen. 2. The item won’t turn on even after 12 hours of charging. The package was beautiful and did not look like someone had previously opened it but, it’s scratched and won’t work. I really don’t mind the scratch because that should not affect the production of the product, but the fact that after 12 + hours of charging it and the battery icon with the plug in the middle won’t come off. I called Microsoft, went through all the steps for rebooting the product and after several attempts at that they said that I will have to send it in for repair, but only if I either have a receipt from a reputable dealer like frys, circuit city, etc.. or pay for the repair or return for refund. Can I please return the Zune and if you have another one?? Please call me at the number listed below or on my cell number: *her phone number*. We are both Verified PayPalers with Comfirmed Addresses and the item has been delivered and I provided proof to PayPal of this. Notice at first she said the package was smooshed, and then she said the package was in perfect condition? Suspicious. She provided me with all of her information including address, work address, phone numbers etc so I'm not sure. I highly doubt the Zune has those problems and it would be easy for her to buy a broken Zune off eBay, claim this and try to return the broken Zune to me. I am not planning on just giving her a refund, so if she files a claim through PayPal what do you suggest I say/do and do you think I would be likely to win?

Did he pay for shipping insurance? I think you are not responsible for packages damaged in the mail unless he paid for it.

CL says tho if ur product is damaged, you have to talk to the manufacture of the product or something to get it fixed... how are u suppose to get that fixed???

if theres shipping insurance then file it to fedex, ups usps etc...

if the buyer did not purchase it then it is the buyers responsibility, if you have a return policy stating allowing returns then you have to accept it

ex returns accepted in 7 days buyer pays return shipping and 15% restock fee,,such as that

I had $100 insurance on the package though (UPS always has this), but I still don't want to give her a refund because I just don't believe her. I'm not sure how the UPS insurance works though.

Yeah. I hope PayPal will come through for me when/if she files a claim. They should because it would not be hard at all to buy a broken Zune on eBay and pull this scam over and over...

I shipped to a confirmed address and I am a verified account though, so it says I am eligible for Seller Protection if I follow all the guidelines, which I did. I'll see where this goes and keep you guys updated.

Did you not have shipping insurance? That's like the seller's responsibility and mandatory for something this valued.

Its not your fault and if you don't believe her then just ignore the message because once a customer pays for something its their responsibility to decide whether they want insurance.

Anyways, I'm having her take pictures and she is going to just send the Zune back to me. I'll take it up with the UPS near me. It had $100 insurance anyways and I could sell the broken Zune on eBay for around $50 probably. So if I can get the insurance money and sell the broken one I would get around $150 anyways, the price I sold the new Zune for.

but maybe she is experiencing buyer's remorse (regret) so she is smashing it up on purpose and sending it back to you. but that's unlikely.

i had a similar problem recently i sold a samsung instinct brand new in the box only opened to take a pick and turn on to check functionality well the person who bought it had it a week and said it did not work and the screen was white so he wanted his money back then went on to say that they changed their mind and wanted a ipod and also contacted me out side of ebay .......needless to say no money was returned....
