No, You arn't understanding; No matter if all your games are REAL from the store games and you have a flashed dvd drive...YOU WILL GET BANNED!
This isn't because of games or anything, this is because they have found a way to accurately check firmware and see if it's legit or not.
You could flash and never have played a game on your box and you will get banned. The ONLY WAY around it right NOW, is to flash to the original firmware till a updated firmware comes out and more is found out about how the firmware is being detected
