Although it's not illegal under law doesn't mean that they can't throw a lawsuit at him. Any automated software used for profit or amusement can get you in trouble. Although they would most likely go after the creator of the software instead of the user of the software. I'm not saying it happens a lot of is going to happen but simply saying it's not illegal under US law doesn't mean you're not at risk.
For example: Earlier this month Blizzard won a lawsuit against people who created bots for World Of Warcraft and that's just a video game.
